Somaliland elections: Observers welcome progress towards setting date for poll

As part of the UK-based team coordinating election observers for the much-delayed presidential elections in the internationally unrecognised Republic of Somaliland, Progressio today welcomes recent progress made to resolve the Somaliland voter registration process – a key sticking point – and calls on all parties to push ahead and set a date for the poll.

Progressio, the Development Planning Unit at University College London (UCL) and Somaliland Focus UK say in a joint statement: “Since September 2009 we have seen a marked improvement in the situation, when all three of Somaliland’s political parties signed a six-point agreement by which the government guaranteed that a further extension of office would not be sought and that the disputed and delayed process of agreeing a voter register would be recommenced. The agreement was subsequently approved by Somaliland’s upper house, the Guurti (House of Elders).”

The statement continues: “This development was quickly followed by improvements in the relationship and renewed understanding between the country’s National Electoral Commission (NEC) and the donors who are providing funding and technology for the voter registration process and the election itself. We are heartened by this progress, and look forward to completion of necessary processes (namely, agreement on a voter register) to allow an actual date to be announced. Indeed, as election observers, it is impossible for us to proceed with making plans for our mission until a date is set.”

It concludes: “Despite lack of international recognition of its claim to official statehood, Somaliland – “Africa’s best-kept secret” – has been characterised by many as a beacon of democratisation in Africa in contrast to the chaos in neighbouring Somalia. However, the delaying of the presidential poll is causing severe damage to Somaliland’s reputation. We therefore urge all stakeholders to do their utmost to maintain the positive momentum to ensure the poll is carried out, with as little delay as possible. This must include genuine commitment from all players and a realistic approach to the time needed to ensure a smooth and proper political process.”

The UK-based team, along with FOPAG (Forum for Peace and Governance) in Somaliland, was invited to lead the election observation mission by the Somaliland National Electoral Commission in January 2009. The team has been tasked with coordinating international election observers from four continents and preparing a report on the conduct of the campaign and poll following the vote. Support for the mission is being provided by the UK government.

Somaliland Focus (UK) Chair, Michael Walls, said: “While Somaliland’s progress since 1991 has been remarkable, the next election marks a significant new step in establishing a legitimate system of national government. We applaud recent successes and look forward keenly to agreement on a voter register and the announcement of a viable election date with genuine cross-party support in the near future. Without those steps, the genuine achievements of the past 19 years will be dealt a profound blow”.

3.  Somaliland is situated in Somalia’s northwest. It declared unilateral independence from the failed Somali state in 1991 and has since been a haven of relative peace whilst violence and instability has characterised Somalia, its capital Mogadishu and more recently the Gulf of Aden.

The  political standoff in the unrecognized  de-facto republic of Somaliland, is a critical development that is worth an international close watch.

The current political standoff if well analyzed  is not of a recent emergent, but have been gradually building up since the coming to power of the current ruling regime . It is unquestionably clear from  the way the current regime has shattered the economic  progress of this tiny entity . They simply  imposed a stifling tax policy  over  the once vibrant free market. The intentional strategy  eventually turned the once sprawling port of Berbera into a ghost port  town.

In its relative peaceful  years  compared to the southern parts of the  former Somali republic. Somaliland  have  initially been on a positive  and fast transitional path, towards political and  socio-economic development.

Many would ask why would an administration stifle its own economic well being . Well this can be well explained by an article written about Somaliland, by a visiting American pentagon official to Somaliland  in April 2003. (and  I’ Quote some part) “It does not threaten its neighbors, except through competitive trade and market practices. The free trade environment in tiny Somaliland has indeed caused complaint by nearby statist entities of Ethiopia, Djibouti and to a lesser extent Eritrea http://www.lewrockwell.com/orig3/kwiatkowski2.html. This was  shortly before the current regime came to power.

The incumbent executive  head was by then a vice president .He came to power after a sudden death of the previous head of state in august, 2003. The once complaining neighboring statist state did not waste the opportunity of negotiating with this product of accident regime, embarking on a process of  undermining  Somaliland progress from within.

executing the deal, for the past seven years the current regime have  been busy on  various well orchestrated strategies of slowly suffocating the principal Somaliland fundamental purpose , which is to attain  international recognition  as an independent sovereign state.

In doing for the past seven years, this the regime has been investing on creating a brutal  police and intelligent forces, to forcefully silence  the voices of democracy. A structural force reminiscent to the once notorious  Somali  red berets, and the National intelligence services (NSS) in which the current president and some of his close henchmen passed as decorated officers .This is evident from the recent police  brutal force against  non provoking  peaceful demonstrators in the capital Hargeysa.

This regime  ganged up with  the current  member of  the sitting House of Elders under a quid pro quo terms, to unconstitutionally extending each other’s terms. The House of elder took their extension in lump sum of four years in 2006, and with an  irrelevant reference and use of the constitution, the elders have extended the president’s term more than thrice. one took place in may 2008 http://www.somalil3andtimes.net/sl/2008/329/1.shtml another one  just six months ago, http://www.somalilandglobe.com/342/guurti-move-jeopardizes-return-to-democracy-in-somaliland/ and   one more is being  formulated as we speak.

This time around the standoff   has turned into such a convoluted power scramble with an injection of intricate wave of clannish undertones  in the intent of  fully deviating from the constitution basis ,and total disregard to all past agreements. The system is set to  go around in a circle and is overshadowed with conceited  tribal process .If finally things ends in such a turn, then the  eighteen years toils of democratic growth would all be nothing but a waste.

before   coming to a conclusion ,let me pose two simple questions to  all  that are for pro-presidential term extension .

1.  What  are the possibilities of elections ever happening if the incumbent regime is always assured of farther extensions?

2. Secondly  the current regime have proven that it can easily  deploy the  law enforcement against its equal branch of  government, after it brought  to a halt  parliamentary procession for days, and farther brutally suppressed peoples sentiments . In lieu of all this, what would restrain this loose  and unchecked regime from using same tactics to disrupt  or rig the unforeseen elections?

It seems that the whole project  has now come to a moment of truth . To those that are genuine about Somaliland  progress and success, the situation is between a rock and a hard place.

Genuine Somalilanders need to cautiously tread on this orchestrated trap with vigilant care. The opposition have the ability of  putting a check on this  conspiracies. Conditionally they momentarily put aside their party differences and power thirst. They need to concentrate on one common goal and  cooperate with the genuine civil society, elders and  not forgetting friends of Somaliland all over the globe.

All in all Somaliland must be  saved from tyranny and collapse, which would eventually lead to an additional perpetual chaos in the region.

Somaliland American Council (SAC) is dismayed by and condemning the actions of President Dahir Rayale’s government that resulted for the death of innocent people who were exercising their right to demonstrate SAC also condemns Rayale government for closing down the people’s house (the parliament). There are three reported deaths of innocent people today and dozens of injured people. The police fired live bullets on unarmed citizens who were demonstrating in front of the Somaliland parliament to show their support to the members and the leadership of the parliament. This is a direct violation of the Somaliland constitution, international human rights, and the young democratic process in Somaliland. The government action is precipitated when the parliament debated a motion to impeach President Rayale for failing to hold elections in Somaliland.

The Somaliland government has been in office for 7 years and failed to hold elections so far; the government was elected to office for 5 years, at the end of its term in office, President Rayale failed to hold elections, then members of Guurti have extended the term of the government for 12 months once and 6 months the second time to hold elections; the election has not taken place yet, and the second 6months extension will expire at the end of October 2009. The reports from Somaliland last week indicated that President Rayale is planning to sent a 3rd request for extension to the Lower House of Guurti very soon.

The people are exercising their right to protest by demonstrating against the actions of the government to close down the parliament and its failure to hold the elections after being in office for 7 years. SAC calls on the Somaliland government to exercise restraint and respect the rights of its people. SAC calls on the people to strongly defend their rights peacefully and do not accept the dictatorial actions of the Rayale government. The people has suffered tremendously and paid dearly with over 100,000 lives lost (under Siad Barre’s regime ) to gain these rights and they are prepared to die to protect their rights again.

The Somaliland parliament is doing the right thing to pressure the government to hold elections immediately and to give he people the right to choose their leaders. SAC calls on the members of Guurti to do the same; by standing with the people and protecting democracy in Somaliland. SAC calls on the “Guurti” to refuse to give 3rd extension to President Rayale – after his letter of request for 3rd extension is received in few weeks. Rayale’s government has indeed damaged the hard-won reputation of Somaliland and its people. SAC calls on Rayale to resign and give the people the right to elect their president.

We have been following, with ever increasing dismay, the delays in the presidential and local government elections and the continual constitutional and political crises over the last four years. We are appalled to see that the reputation of Somaliland as an oasis of peace and a country built on consensus and compromise slowly being dismantled. Our democratic journey is plainly off course; citizens are in our prisons without trials and numerous journalists have been detained and imprisoned. The judiciary is firmly under the control of the executive and the legislative has been emasculated by the executive, so much so that its doors have been literally locked on the order of the President.

In the last few weeks, the House of Representatives has finally decided to debate an impeachment motion, but this again escalated to a position where the House was closed down on the orders of the President. A promise by the President given to the Elders and traditional leaders that the Representatives will be allowed to get back to their premises was not carried out and consequently citizens incensed by the continued closure of the House were shot at on Saturday, 12 September. Two died and many were injured.

The Articles of Impeachment at the House of Representatives list some of the many alleged infringements of the Constitution and the law committed by the President and the Vice President. We will not rehearse these, but it is clear to everyone that these allegations and the recurring political and constitutional crises during the last few years have set the nation back.

The presidential election has been postponed to an indefinite date. We are now yet again at another impasse, but this time, with the already twice extended terms of office of the President and the Vice President, no further extension is acceptable legally or politically. Many of us considered these previous extensions as unconstitutional and the nation will not accept another extension even if the President manages to get it through the House of Elders.

We urge that the President/Vice President act well before the end of their extended term on 29 October 2009, and let the nation know of their resignation as soon as possible so that the constitutional caretaker President can take over with the sole brief, under Article 89(4) of the Constitution, of holding the presidential elections within 60 days.

We do not think that all the problems in Somaliland are caused by the leadership of the Executive, but to paraphrase another president, the “buck stops” with them. The presidential system of government we have chosen does not mean that without elections the incumbent President who has failed to hold elections on time should forever remain in power – that is dictatorship and not democracy. We also point out that President Rayaale had ample time – 5 years as Vice-President and 7 years as President – to shape the future of the nation and it is time he and the Vice President step aside and allow the country to get back on its tracks. History will, we believe, be kinder to both of them if they spare the nation further instability.

Finally:

• We ask all other Somaliland Diaspora Organisations to make the same appeal to the President and the Vice President, so we can save Somaliland from further chaos and destabilisation.
• We appeal to the friendly nations to facilitate the temporary constitutional transfer of power and to assist more boldly in both the forthcoming elections and in the provision of resources for capacity building and direct assistance to the Somaliland Parliament, so that, the latter can, for example, employ a civilian sergeant- at-arms in charge of the security of its meeting halls and premises.
• We urge all nations to assist Somaliland financially and diplomatically and to welcome it finally to the comity of nations so it can contribute more to the building of democracy, and peace and to combating of terrorism and piracy in the region.
• We send our condolences to the bereaved families in Hargeisa and our wishes to the injured. We urge the two Houses to set up as soon as practicable a joint committee to enquire into events of the last few days

Confrontations between demonstrator and the police caused a number of deaths and wounded in Hargeysa today. The disturbance was caused when crowds gathered to watch members of parliament attempting to re-enter the Parliament building after the Somaliland administration closed the building down when a resolution to impeach the president was introduced in the chamber earlier in the week.

Allowing the Parliament to come back to session today came to being after negotiation between the president and the chairman of the Elders (Guurti) Mr. Suleban Mohamud Adan. Apparently the president expected the impeachment proceedings to be tabled now that he has allowed Parliament to come back to session, and the chairman of the Guurti was under the impression that there were no conditions attached to allowing the parliament to come back into session, nor could he negotiate on behalf of the Parliament.

When it became clear to the president that the Parliament was not backing down from the issue of impeachment, the decision was made to impede and block some members of the opposition parties to enter the building; this in turn created the condition that sparked the confrontation between the people and the police.

The president is calling for young people to stay home and not protest any longer, but it is hard to say how that message will be received by people who feel neglected and abused for so long. What tomorrow will bring is anyone’s guess as everyone is scrambling to find a way out of this train wreck and UN Special Representative Mr. Ould Abdallah is back again in Hargeysa after visiting there last week.

All indications are that the Rayale administration is having some serious misgivings about the intricacies of democracy when it comes to the separation of powers and conducting timely elections, and with this latest incident the president has lost the only trump card left for him, and that is to safeguard the existing peace. It is difficult to claim that one is for peace, when one is engaged in the very actions that destroy the peace he is asking others to safeguard.

If there was ever a doubt that this president should be impeached, such doubts are no longer viable ones, and for the benefit of the nation and whatever dignity the president has left in him, he should resign and allow this country and these people to resume their natural progression toward democracy and continued stability.

The alternative is more bloodshed and misery, but the outcome will be the same, your reign is over Mr. president, your legitimacy is shattered and the outcome is a foregone conclusion, the only thing in doubt is whether you will leave office willingly or unwillingly.
For the sake of our nation we hope you choose the former.
